Pop star Katy Perry's Kisses-inspired outfit graces Rolling Stone cover

Perry, who has two songs in the top 10 of Billboard’s Hot 100 list, appeared on the cover clad in a busty outfit designed to look like a pair of one of America’s favorites: the iconic Hershey’s Kiss.
    
Sorry, boys, but “Katy’s Kisses” are not for sale at a local candy retailer.
    
Perry is undoubtedly thrilled to be once again on the cover of the magazine, but what about The Hershey Co., well known for its conservative, family-oriented values?
    
Apparently, even the executives who control the Fortune 500 firm are allowed to crack a smile now and again.
    
“We’re flattered that Katy Perry is such a passionate fan and that her art is inspired by our iconic Kisses milk chocolate,” said Kirk Saville, Hershey Co. spokesman.
    
The chocolate maker was clear that it does not have any official ties to Perry. They are not, for instance, sponsoring her tour. Nor did they help design her silver dress.
    
In the past, Hershey has aggressively defended its trademarks, which include the conical shape of Hershey’s Kisses. In the photographs, Perry appears to copy the trademark with the conical shape of her ... outfit.
    
But the difference between her brassiere and, say, the company’s recent lawsuit against Mars Candy over the use of color in packaging is a matter of artistic impression and free speech, said Jeff Sharp a professor of intellectual property rights at the Smeal College of Business at Penn State.
    
“Art and artists, because of the First Amendment, get a little more [leeway],” Sharp said. “As long as they are not actively putting out a product for sale ... then they are pretty clear in their First Amendment rights.”
    
So, as long as Perry doesn’t actually sell “Katy’s Kisses,” she is well within her rights as an “artist” to wear the outfit, which she does while on tour.
    
And people who follow pop culture, such as Scranton-based syndicated radio host Ralphie Aversa, say the Rolling Stone image, which blends sexy and sweet, is pretty true to Perry the person.

Colleges are filled with smart people, but nobody gets rewarded just for their brains. Many of those brainy people know they've got to go asking for money when they want it. So it's no surprise that colleges are among the most prodigious users of lobbyists. Every piece of paper a person signs and sends to uscis is done under "penalty of perjury". Even though there is protection such as 245k; uscis can use the "perjury" and document fraud to override all of these friendly type policies. If they think a person is dirty or trying to get away with something then they will dig even harder until they find something. I remember as an auditor; a company wanted to fire their CFO but couldn't find a performance reason. Easiest way was to go to the persons expense report because everyone fudges it and this is essentially how he got fired. USCIS knows that if they dig hard into someones file they will find something. Many people don't really understand the investigative powers uscis has or the extent they will go through. if person fakes paystubs to do an h-1b transfer; well uscis issues rfe's asking for a listing of all h-1b employees and payments made to each employee for last two years. I have seen them inter-relate this information for people who have faked these types of things. Recently; I saw uscis california service center request state unemployment compensation reports for all employees for wages paid for the last two years. the service center actually picked four people who were paid substantially less and pulled their h-1b files and pointed this out in their denial that they coudn't trust the companies assertions on the LCA and they had to deny the petition for the current beneficiary. Frankly, this is very very scary - I do not know what to say here. As per law, USCIS should only worry about what happenned after the last lawful admission into United States.
